# Chapter 12, claim 5, the second fleet reading, utilization

Due 31 December 2027

**The test.** Utilization of the 2023–24 H100 fleets holding at 75 percent or more weakens the claim. Utilization below 60 percent is the named channel opening. Without a series that can separate those fleets by 31 December 2027, the reading is set aside as unscored.

unscored Unscored. No such series exists; the one market measure on the record, the rented share of the capacity Ornn tracks, from a marketplace that both prices compute and rents it, has nothing to separate a 2023–24 fleet from any other.
